PENGANTAR

Tulisan ini adalah inisiatif pribadi pengetik untuk mencoba membantu rekan-rekan yang berusaha memahami wording Munich-Re di bidang asuransi engineering. Tulisan ini mencantumkan wording aslinya di tengah-tengah, diapit oleh uraian dari pengetik di sebelah kiri, dan beberapa catatan tambahan (diawali +++) di sebelah kanan, atau pertanyaan untuk merangsang berpikir lebih lanjut (diawali ???), atau juga satu-dua peringatan (diawali !!!). Bila masih ada tempat kosong, beberapa gambar atau keterangan atas istilah tertentu, atau link ke arah sana, ikut menambah ramai tulisan ini.Tentu saja uraian pengetik bisa melenceng, keliru, atau salah sama sekali. Oleh karena itu tulisan ini perlu dibaca hati-hati, dan penggunaannya menjadi tanggung jawab si pemakai sepenuhnya. Koreksi atas hal-hal yang keliru ini tentu saja sangat dinantikan agar tulisan ini bisa terus diperbaiki.Uraian pengetik tidak selalu menjabarkan semua yang ada di wording. Terkadang beberapa detail di wording tidak disebutkan di uraian; sebaliknya satu dua uraian mungkin lebih mendetail daripada wordingnya sendiri. Karena itu harap selalu periksa ulang wording aslinya.Pengetik juga sengaja menyingkat beberapa istilah, misalnya menggunakan kata tunggal kerusakan untuk loss of or damage to; atau tidak menterjemahkan beberapa istilah tertentu; atau menggunakan kosa kata bukan bahasa Indonesia, tapi agak lazim dipakai di obrolan sehari-hari, misalnya deductible, endorsement, dsb.Khusus untuk pembahasan endorsement: Meski semua endorsement Munich-Re untuk CPM dimuat di sini, tetapi yang dibahas hanya yang biasa atau terkadang ditemui pemakaiannya di pasar tanah air. Sisanya hanya dicantumkan saja tanpa komentar. Begitu juga endorsement berkepala nol, seperti MR001, MR006, dsb. tidak dimuat di sini (ini akan dibahas di tulisan lain).Juga tidak dibahas lagi: kalimat standard Munich-Re di awal tiap endorsement, yaitu

MR400 menjamin kerusakan pada peralatan yang dioperasikan di bawah tanah akibat perils sbb:• banjir• genangan air• tanah longsor• batu longsor• tanah anjlok• runtuhnya lubang masuk

terowongan• runtuhnya terowongan dan

sejenisnyahingga batas jaminan yang tercantum di sini.Tetapi kerusakan akibat ditinggalkannya peralatan ini tidak dijamin.

!!! Sebagian orang menterjemahkan “subsidence” sebagai “tanah amblas”. Menurut KBBI “amblas” artinya “habis”. Tampaknya “tanah anjlok” bisa lebih tepat.

Endorsement 410Adjustment of Sum Insured and Premium

It is agreed and understood that otherwise subject to the terms, exclusions, provisions and conditions contained in the Policy or endorsed thereon, the following alteration of Memo 1 (see the Provisions of the Policy) shall apply to this insurance:

The Insurers shall waive the right to apply underinsurance, provided the sum insured at the beginning of the insurance was correctly fixed and the premium as well as the sums insured are adapted at each renewal date (annually) to the changes in machinery production prices and the cost of labour.

MR420 menambahkan beberapa ketentuan bilamana polis CPM akan digunakan untuk mengcover peralatan yang digunakan di dalam pengeboran minyak dan panas bumi.

Endorsement 420Cover for Oil, Gas and/or Geothermal Drilling Rigs and Equipment

It is agreed and understood that otherwise subject to the terms, exclusions, provisions and conditions contained in the Policy or endorsed thereon and subject to the Insured having paid the agreed extra premium, this insurance shall be extended to cover:

+++ MR420 menyebut “this insurance shall be extended to cover” padahal sebenarnya wording CPM sendiri tidak secara eksplisit meng-exclude “oil, gas and/or geothermal drilling rigs and equipment” kecuali barangkali exclusion l yang meng-exclude “working undergorund”).

1. as listed in the Schedule, drilling equipment and oil and gas well servicing equipment, as well as spare parts, derricks, boilers, drill pipes, tools and miscellaneous appurtenances incidental thereto and used in connection therewith or used by the Insured or for which the Insured may be liable;

Point 2 menegaskan bahwa• jaminan berlaku• di wilayah yang tersebut di Ikhtisar• selama alat pengeboran tidak

dipasang di atas kapal atau barge;• perubahan wilayah bisa diizinkan jika

ada pemberitahuan 10 hari sebelumnya dan adanya penyesuaian premi.

2. the items listed in the Schedule whilst within the territory stated in the Schedule and not situated or installed on vessels or drilling barges; but it is agreed and understood that in case items are moved from this territory to another, the Policy shall continue to cover them subject to prior notification within 10 days and revision of premium;

4. loss of or damage to drilling tools, equipment, machinery or parts thereof working underground, but only if caused by blowout, cratering, fire, explosion.

Definisi dari blowout:• ekspulsi mendadak dari fluida yang

digunakan dalam pengeboran (mis. lumpur, air)

• diikuti oleh aliran tak terkontrol dari minyak/gas/air dari lubang pengeboran

• yang terjadi bila tekanan minyak/gas/air di bawah permukaan ternyata lebih daripada tekanan yang digunakan oleh pilar fluida pengeboran

• dan mengakibatkan sumur bor sama sekali di luar kendali.

The term “blowout” shall be defined as a sudden expulsion of drilling fluid (mud, water) followed by an uncontrolled flow of oil, gas or water from the well that occurs when the pressure of oil, gas or water entering the well at some depth below the surface is greater than the pressure exerted by the column of drilling fluid in the well and results in the well getting completely out of control.

Definisi dari cratering:• bukaan di permukaan bumi,

berbentuk kawah, muncul di sekeliling sumur bor,

• yang terbentuk dari aktivitas erosif dan eruptif dari gas/minyak/air yang mengalir tanpa hambatan.

The term “crater” shall be defined as a basinlike opening in the earth’s surface surrounding a well caused by the erosive and eruptive action of gas and/or oil and/or water flowing without restriction.

Paragraf ini menyebutkan bahwa MR420 mengecualikan jaminan atas:• bahan pemadam api dan material

lain yang musnah, terpakai, atau hancur di dalam pemadaman kebakaran, atau karena blowout dan cratering,

• begitu juga segala biaya yang digunakan dalam memerangi kebakaran, atau usaha mengatasi blowout dan cratering.

This insurance does not cover loss of or damage to foam solutions or other fire extinguishing materials as well as all other materials lost, expended or destroyed in fire fighting, blowout or cratering, or any other expense incident to fighting fire, controlling or attempting to control blowout or cratering.

• BOP (blowout preventer) keluaran standard harus terpasang di permukaan;

• BOP ini harus dipasang dan ditest secara rutin sesuai ketentuan standard;

• hasil test harus diarsipkan;(warranty ini tidak berlaku untuk cable tool rigs).

- blowout preventers of standard make shall be set on the surface casing, same to be installed and tested regularly in accordance with good oil-field practice, records being kept thereof (this warranty not being applicable to cable tool rigs),

• Tertanggung tidak boleh menggunakan zat sbb. sebagai fluida pengeboran: minyak, udara, lumpur yang aerated,

• tetapi Tertanggung tetap boleh menggunakan lumpur berbasis minyak atau minyak untuk “drilling-in”, dan juga minyak untuk aktifitas “washing-over”, “fishing” dan sejenisnya.

- oil and/or air or aerated mud shall not be used as a drilling fluid; but this shall not exclude the use of oil base (inverted) mud or the use of oil for “drilling-in” or the use of oil for “washing-over” or other “fishing” purposes,

• Khusus untuk “rotary drilling” dan “workover” peralatan harus dipakai dengan hati-hati dan sesuai dengan aturan perundangan yang berlaku.

• Peralatan hanya boleh dioperasikan oleh Tertanggung atau pegawainya, kecuali disetujui lain.

- the insured item shall be operated only by the Insured or the Insured’s employees, unless otherwise agreed by endorsement hereto.

Paragraf terakhir ini membolehkan adanya “waiver of subrogation” terhadap pihak service atau penyewa kalau kontrak mereka memang menyebutkan bahwa mereka tidak bisa diminta pertanggungjawaban.

This insurance shall not be violated by the waiver of subrogation against service organization and/or lease owners whose contracts provide that they are not liable.

Endorsement 421Cover for Water Well Drilling Rigs and Equipment

+++ Bandingkan exclusion l di polis.

MR421 menjamin kerusakan pada peralatan pengeboran sumur air (bukan sumur bor minyak/gas/panas bumi).

It is agreed and understood that otherwise subject to the terms, exclusions, provisions and conditions contained in the Policy or endorsed thereon and subject to the Insured having paid the agreed extra premium, this insurance shall be extended to cover:

drilling rigs and equipment warranted that such equipment is not used for oil, gas and/or geothermal drilling or for work on existing oil, gas and/or geothermal wells.

Paragraf ini mengubah exclusion l-nya polis induk dengan menyebutkan bagian-bagian apa saja yang di-exclude. Tetapi:• pengecualian ini hanya berlaku

selama bagian itu berada di bawah rotary table atau permukaan tanah,

• pengecualian ini tidak berlaku atas perils gempa bumi, kegiatan gunung berapi, tsunami, badai, cyclone, banjir, genangan air, kebakaran, ledakan, dan air artesis.

Furthermore, Exclusion I of the Policy is amended by the following wording:

“Loss of or damage to drill pipes, collars, rock bits, reamers, stabilizers, core barrels, logging equipment, casings and tools of all kinds while below the rotary table and/or below the ground level. However, above items shall be covered if the loss or damage is caused by earthquake, volcanism, tsunami, storm, cyclone, flood, inundation, fire, explosion and artesian water.”
